Nagaland: Government orders demolition of unauthorized structures along national highways

The Department of Works and Housing (Works Branch), Government of Nagaland, has notified that the construction or operation of any new dhaba, eatery or commercial structure within the Right of Way (RoW) of any National Highway is prohibited with immediate effect.

The directive has been issued in compliance with the orders of the Supreme Court dated April 13 and July 13, 2026, in Suo Motu Writ Petition (Civil) No. 9 of 2025, Phalodi Accident versus National Highway Authority of India and Others.

All Deputy Commissioners have been directed to strictly enforce the demolition and removal of all new or existing unauthorized structures located within the Right of Way of National Highways, in accordance with the Supreme Court’s judgment.

It further stated that the enforcement process shall be carried out in accordance with the provisions of the CNH Act and the Standard Operating Procedure (SOP) dated August 7, 2025.
