The Phek District Legal Services Authority (PDLSA) organized a legal awareness program at Phek Village Panchayat Hall on January 14.
The program was chaired by Khotsozo Venuh, PLV, Phek DLSA, while the welcome address was delivered by Chivozo Soho, Chairman of the Phek Village Council.
Vethothi Vero, Retainer Lawyer, spoke on “Basic Procedures of Law, FIR, and Bail in India.” He explained that the First Information Report (FIR) is the initial step in a criminal case and must be filed at the nearest police station where the crime occurred. It should include details of the complainant (name, address, etc.), specifics of the offense (date, time, place, and description), the name of the accused (if known), and any witnesses (if available).
He further clarified that bail is a legal process allowing an accused person to be released from custody while awaiting trial.
Sekhotso Rokha, Panel Lawyer, Phek DLSA, spoke on “Rights of an Arrested Person in India.” He emphasized that the Indian Constitution and various laws safeguard the rights of arrested individuals to ensure fair treatment.
He highlighted that an arrested person has the right to consult and be defended by a lawyer of their choice. Regarding the Right Against Illegal Detention, he explained that no one can be detained for more than 24 hours without a magistrate’s permission. For serious offenses, the magistrate may authorize police custody for up to 15 days.
Additionally, the arrested person has the right to a fair, speedy, and public trial.
