33% reservation for women in Nagaland ULBs
Mokokchung, July 14 (MTNews): The Supreme Court on Thursday has once again reprimanded the Nagaland state government for putting off implementing the intended 33% reservation for women in local authorities.
A Bench of Justices, Sanjay Kishan Kaul and MM Sundresh, were notified that the Nagaland State Election Commission had received administrative authority to execute the reservation. However, the Bench objected to the delay in the procedure’s execution, noting that the permission was only made known on July 12, legal news portal barandbench.com reported.
It was pointed out that only when the matter was listed before court, something was done. Justice Kaul went on to explain that the Court did not trust the State government, and was thus forced to monitor each stage of the election.
“We have no trust in the state government…12 years! Something which could have been automatically done, requires so much effort. Very sad state. You talk about gender equality. This is the part of the country where women are extremely educated. They are required all over the country,” the judge observed.
The Nagaland State Assembly passed a resolution on September 22, 2012, exempting the state from the application of Part IX-A of the Constitution, which calls for a 33 percent reservation for women in local bodies. The resolution was challenged in a petition filed by activist Rosemary Dzuvichu and the People’s Union for Civil Liberties (PUCL).
Even though the reservation has not yet been enacted, the Nagaland Assembly withdrew the aforementioned resolution in 2016.
When Will You Notify Elections of Municipalities And Town Councils? Supreme Court Asks Nagaland State Election Commission.
The Supreme Court justices also asked the Nagaland State Election Commission to inform the court by when they would notify the elections of Municipalities and Town Councils.
In response, the Bench was informed that the election procedure would take 45 days starting immediately after the publishing of the electoral rolls.
The Bench was given the assurance that action would be done right away. As a result, the State Election Commission was instructed to provide an affidavit within two weeks stating the day on which the elections will be announced.
“At each stage there has been a delay on part of the State…its endeavour to defeat the rights of the women. It seems even 12 years is not enough delay,” the Bench observed before listing the case for further hearing on July 29.
In February, the Court had granted the State government a final opportunity to implement the reservation. It came down on the State after going through a report filed by the State Election Commission in the matter.
“The report is once again reflection on the lackadaisical attitude of the State Government even in furtherance of assurances given to this Court apart from the fact of the legal mandate which they are required to follow,” the Bench had observed.

After the administrative approval for conduct of ‘Intensive Revision’ of Electoral Rolls for all the 39 (Thirty Nine) Municipal/Town Councils on 12 July 2022, Nagaland State Election Commissioner, Rovilatuo Mor, IAS has directed that an Intensive Revision of the Electoral Rolls for all the Municipal and Town Council in Nagaland shall be taken up with reference to 1st January, 2022 as the qualifying date according to the schedule indicated as under:
