Kohima, 11 August (MTNews): In honor of the forthcoming 77th Independence Day on 15 August 2023, the Government of Nagaland has announced the remission of sentences for specific categories of prisoners who have been convicted by courts with criminal jurisdiction within the state. This gesture aims to commemorate the spirit of freedom and independence.

 

The State Government, exercising Article 161, has granted remission of sentences for various categories of prisoners incarcerated in both Nagaland’s jails and facilities outside the state. However, this remission doesn’t apply to prisoners whose sentences pertain to offenses under laws covered by the Executive Powers of the Central Government.

 

The following scale of remission has been outlined for different categories of prisoners:

· Prisoners sentenced to 10 years and above – 30 (Thirty) days

· Prisoners sentenced to 5 years to 10 years – 20 (Twenty) days

· Prisoners sentenced to 1 year to 5 years – 10 (Ten) days

· Prisoners sentenced up to 1 year – 5 (Five) days

 

It is essential to note that the aforementioned Remission Order will not be applicable to convicted prisoners under the Foreigners Act; the Passport Act; the Unlawful Activities (Prevention) Act; Sections 3 to 10 of the Official Secrets Act, 1923; Sections 2 to 3 of the Criminal Amendment Act, 1961; Sections 121 to 130 of IPC; Sections 107/109 of CrPC; the Prevention of Corruption Act, the Narcotic Drugs and Psychotropic Substances Act, 1985.

 

The Remission Order will also not be applicable to convicted prisoners of rape, attempted rape, or assault on women; convicted prisoners found violating jail rules and discipline, including threats, intimidation, quarreling, assaulting fellow inmates or staff, and smuggling prohibited items; and foreign nationals convicted under any Acts.

 

The Remission Order will be effective from 15 August 2023, symbolizing the state’s commitment to embracing the spirit of freedom and compassion.
