Nagaland sets up commission for reservation policy; Panel given six months to recommend equitable policy

The Commissioner & Secretary, Personnel and Administrative Reforms (P&AR) Department, Government of Nagaland, Mohammed Ali Shihab, IAS, has constituted a Job Reservation Commission to examine and submit a report on the Reservation Policy in government employment, and to make recommendations for a suitable policy governing equitable representation of various tribes of the State in government jobs.

According to the notification, the Commission will comprise the following members:
1.R. Ramakrishnan, IAS (Retd.) – Chairman
2.Administrative HoD of Home Dept/Home Commissioner – Member
3.Administrative HoD of Law & Justice Dept – Member
4. Administrative HoD of Higher & Technical Education Dept – Member
5.Administrative HoD of P&AR Dept – Member Secretary

Powers of the Commission

The Job Reservation Commission has been vested with powers to access all government records and documents relevant to its work, and to call any government official or department to brief it on issues relating to its terms of reference.

Terms of Reference

The Commission has been tasked to:
·Examine constitutional and statutory provisions governing reservations in government employment in the Centre and other states.
· Critically examine educational and economic parameters applied for determining criteria for reservation.
·Examine the existing Job Reservation Policy in Nagaland and its impact on representation of various categories in government employment.
·Hold consultations with apex tribal bodies and stakeholders including students and employees’ associations on equitable application of the policy.
·Propose criteria for determining which tribe may be considered for reservation, the overall percentage of reservation, and its inter se distribution.
·Examine the extent to which reservation addresses the backwardness of a tribe, and recommend the period for such provisions.
·Review the implementation and monitoring mechanism of the policy, identify gaps and suggest measures, including technology interventions, to make the system robust and foolproof.
·Submit recommendations to the Government based on its findings.

The Commission will submit its report within six months. The Home Department will provide office space, secretarial and logistical support, while the Finance Department will make necessary budgetary provisions. Details of the remuneration and honorarium of members will be notified separately.
