FBO sentenced to simple imprisonment, fined Rs 1 lakh
The Chief Judicial Magistrate (CJM) Court, Dimapur, has convicted a food business operator under the Food Safety and Standards Act, 2006, sentencing the operator to simple imprisonment and imposing a fine of Rs 1 lakh.
The conviction, delivered on August 4, was under Section 59(i) of the Act, according to the Directorate of Health & Family Welfare, Food Safety.
The criminal complaint was filed by the Food Safety Officer and Designated Officer of Dimapur Zone, with the State represented by the Additional Public Prosecutor and Assistant Public Prosecutor of Dimapur.
The conviction is the second such case recorded in Nagaland this year. A similar conviction under Section 59(i) was recorded by the CJM Court, Mokokchung, on March 16, with the accused sentenced to simple imprisonment and fined Rs 1 lakh, the department said.
The Health & Family Welfare Department said multiple food safety cases are currently under trial before CJM courts and Adjudicating Officer/Additional Deputy Commissioner courts in different districts of the State.
The department said it would continue legal action against violations of the Food Safety and Standards Act and urged food business operators, including manufacturers, suppliers, distributors, retailers, restaurants, cafes and home-based food businesses, to comply with food safety requirements.
It also urged consumers to report food safety violations to the Food Safety Cells under the offices of the respective Chief Medical Officers or through the Food Safety Connect mobile application.
